Rental conditions

  • The minimum age for signing any contract in Spain is 18 years. In the case of minors, an adult must sign on their behalf.
  • Any fines or parking tickets will be the responsibility of the renter and the amount will be charged to the credit card provided.
  • A deposit is required (the amount depends on the motorcycle model selected), which will be refunded at the end of the contract if no damage has occurred during the rental period.
  • For long-term rentals (monthly), payment will be made monthly and coincide with regular check-ups of the motorcycle.
  • Third party insurance is included.
  • Unlimited mileage is available as an extra.
  • The first helmet is provided along with the moped at no additional cost.
  • Roadside assistance is available as an extra.
  • For UK customers: It is not permitted to rent vehicles to customers holding only a provisional license, as it is only valid within the UK.
  • Non-EU Citizens:Non-EU citizens must present a valid International Driving Permit (IDP) in addition to their national driving license. Both documents must be valid and written in Latin alphabet or accompanied by a certified translation into Spanish or English. The IDP must comply with the 1949 or 1968 Geneva/Vienna Conventions. The renter is responsible for ensuring that their license allows them to operate the class of vehicle rented, as per Spanish regulations. Failure to comply with these conditions will result in the refusal of the rental without any right to refund.

49cc moped

  • To drive a 49cc moped, you must hold a valid moped (AM), motorcycle (A), or car (B) license.
  • Minimum age: 16 years.

125cc scooters

  • In Spain, you are allowed to ride a 125cc scooter if you have held a car driving license for at least 3 years.
  • Minimum age: 21 years.
  • A motorcycle license (A1/A) or a car license held for at least 3 years is required.

400cc scooters

  • Minimum age: Be at least 25 years old.
  • Valid driving license: Hold one of the following licenses valid in Spain: Category A2 or A motorcycle license
  • License validity in Spain: The license must be issued in accordance with Spanish regulations, by a member state of the European Union, or by a third country whose licenses are officially recognized in Spain.

Rental Agreement

VERY IMPORTANT: IN CASE OF ACCIDENTS CAUSED UNDER THE INFLUENCE OF ALCOHOL OR DRUGS, INSURANCE COVERAGE IS AUTOMATICALLY VOIDED.

RENTER – The person signing this contract is considered, for all legal purposes, the renter and responsible for the vehicle, regardless of who made the reservation or payment.

LESSOR – The lessor is RIDERLIX, domain www.riderlix.com. Its employees and affiliates are authorized to act on behalf of the company in this contract.

1. DELIVERY AND RETURN

The renter acknowledges receiving the vehicle described on page 1 of the contract in perfect working condition, with its documents and accessories (helmet, keys, etc.), and agrees to keep them in good condition and operate the vehicle according to the traffic laws and vehicle-specific guidelines. Before delivery, the lessor will inspect the exterior of the vehicle with the renter to record any pre-existing scratches or dents, which will be noted in the delivery form and not charged upon return. The renter accepts responsibility for any other damages present at return, whether during use or while parked.

At delivery, the lessor will explain how the vehicle operates and answer any questions. The renter affirms they understand these explanations and the vehicle's operation.

The renter must refuel the vehicle with the correct fuel type. If incorrect fuel is used, the renter will be responsible for all resulting transportation and repair costs.

The motorcycle must be returned at the date, time, and address specified, in the same condition as received, aside from normal wear. Any delay in delivery, not caused by force majeure (as stipulated in article 1105 of the Civil Code), will incur a penalty calculated by days.

Early return does not entitle the renter to any refund. If the lessor requests early return due to misuse, the renter must comply and waive any claims. Failure to return the vehicle within 12 hours of the scheduled time will be reported to police and treated as theft.

Driving with an expired contract and without authorization from the lessor suspends insurance coverage and releases the lessor from any liability.

2. MECHANICAL WARRANTY

If the vehicle becomes unusable due to mechanical issues beyond the lessor’s control, the lessor is only responsible for refunding the unused rental portion. The lessor may offer a replacement vehicle and adjust the rental price accordingly. If the vehicle is immobilized, the renter must contact the lessor and use the designated roadside assistance. Charges from unauthorized assistance providers will only be accepted in emergencies with prior approval.

3. DRIVER REQUIREMENTS

The renter confirms they meet the age and licensing requirements to operate the vehicle in Spain. Valid licenses include:

  • Those issued under Spanish law,
  • Those from EU member states,
  • Recognized international licenses from third countries.
  • Non-EU Citizens:Non-EU citizens must present a valid International Driving Permit (IDP) in addition to their national driving license. Both documents must be valid and written in Latin alphabet or accompanied by a certified translation into Spanish or English. The IDP must comply with the 1949 or 1968 Geneva/Vienna Conventions. The renter is responsible for ensuring that their license allows them to operate the class of vehicle rented, as per Spanish regulations. Failure to comply with these conditions will result in the refusal of the rental without any right to refund.

The renter affirms they are medically and physically fit to drive and are not under any medication or condition that impairs driving. Driving under the influence of alcohol or drugs is prohibited.

4. VEHICLE MISUSE

Any action that contravenes traffic regulations, the vehicle manufacturer's specifications and the lessor's instructions will be considered misuse of the vehicle. Misuse includes violations of traffic laws, manufacturer instructions, or the lessor’s guidelines. Abnormal wear, especially on tires, will be deemed misuse and charged to the renter.

5. VEHICLE SHARING

The renter may not allow others to drive the vehicle without prior written consent and inclusion as additional drivers. The renter remains fully responsible for any damage or incidents regardless of who was driving.

6. DRIVING LIMITS AND CROSS-BORDER POLICY

Driving limits are based on engine size:

  • 50cc mopeds: 40 km
  • 125cc scooters: 100 km
  • 400cc scooters: 400 km

Distances are measured from the address stated in the contract. Off-road driving, use in ports, airports, race tracks, or closed areas is prohibited. Cross-border travel, including but not limited to trips to Gibraltar, is strictly prohibited.
Any use of the scooter outside the allowed circulation area constitutes a breach of contract and voids all insurance coverage.

Any damage occurring outside the permitted territory will be fully charged to the customer, including repair costs, towing fees, and any expenses required to return the scooter to the rental base in Marbella in case of breakdown or immobilization.

7. DRIVER OBLIGATIONS

The renter agrees to comply with all Spanish traffic regulations. They must check oil, fluid, and tire pressure levels as instructed, and report any mechanical issues promptly. Failure to do so may result in damages that are the renter’s responsibility.

Unauthorized repairs or modifications are prohibited. Violations will result in charges for restoring the vehicle and compensating for downtime.

The vehicle must always be secured using the provided locks. Only unleaded gasoline MUST be used.

8. IN CASE OF ACCIDENT

If involved in an accident, the renter must immediately notify the lessor using the emergency number and follow instructions. The renter must complete the accident form and deliver a signed copy from all drivers involved to the lessor within 24 hours.

The vehicle will not be replaced, and the contract will be canceled without refund unless another party is clearly at fault and proven by a police report or judicial decision.

9. VEHICLE DAMAGE

The renter agrees that any damage caused during the rental, whether while driving or parked, will be deducted from the deposit. The lessor will present a repair invoice and return any remaining deposit.

If the vehicle is unusable for rental due to damage, the renter will also be charged the daily rental rate for each day the vehicle is out of service.

If a full coverage insurance with deductible was purchased, it will cover damage exceeding the deposit, unless the renter violated contract terms.

If no such insurance was purchased, the renter is liable for the full repair cost, even beyond the deposit.

10. LOSS OR THEFT

The renter must immediately notify the lessor and cooperate fully with police and the insurer.

If theft or loss occurs due to negligence, the renter must pay the vehicle’s market value, as per the Ministry of Finance tables. If recovered, the renter bears all inspection and repair costs, plus loss of use based on the current rental rate.

If the renter is not at fault and theft insurance was purchased, they are not liable.

The contract will be terminated regardless, without refund. Stolen parts or accessories must be reimbursed at the manufacturer’s list price plus labor costs.

11. OCCUPANTS AND PROPERTY DAMAGE

The renter and passengers acknowledge the insurance coverage and release the lessor from liability for personal or property damage during vehicle use. This includes burns, cuts, or other injuries.

The lessor is also not liable for lost or damaged personal items or clothing, whether during or after the rental.

The renter must wear equipment required by authorities.

12. FUEL

Using diesel fuel causes severe damage. The renter is responsible for all repair costs and a minimum compensation of €100 for lost rental days. The deposit will remain held until the invoice is issued.

13. FINES AND CHARGES

The renter agrees to pay any fines for traffic or transport violations and towing fees. The lessor will identify the renter to authorities if required.

The renter must cover legal fees, vehicle seizure, and days the lessor cannot use the vehicle due to incidents caused by the renter.

14. UNAUTHORIZED USE

The vehicle may not be used to tow, carry excessive loads, participate in races, drive off-road, or teach others to drive.

It may not be used for illegal acts (e.g., smuggling, transporting illicit substances). The renter may not sell or pledge any part of the vehicle.

Violations lead to contract termination and full renter liability for all damages and legal consequences.

15. INSURANCE

The vehicle includes compulsory third-party liability insurance, covering damage to others and passengers, with no deductible. It does not cover theft, loss, damage to the vehicle or personal belongings, or vandalism.

16. LOST KEYS, LOCKS, AND HELMETS

Lost keys or helmets will be charged against the deposit, including the manufacturer's replacement cost and a €50 administrative fee. If the deposit is insufficient, the renter authorizes the lessor to charge the remaining amount to their card.

17. VEHICLE RESERVATION

TThe lessor will confirm availability at the time of inquiry. If the reserved vehicle is unavailable due to force majeure, a similar model will be offered or the reservation fully refunded.

Cancellations:

  • More than 15 days in advance: full refund
  • 5–15 days in advance: 50% refund
  • Less than 5 days: no refund

Late pickups do not entitle the renter to a refund for missed days..

18. RENTAL PRICE AND CARD CHARGES

The rental price, as well as the security deposit, are determined according to the General Rate in force at the time and must be paid in advance by the renter. Under no circumstances may the deposit be used as payment for an extension of the rental period. Payment must be made by credit card, debit card, or in cash. In the case of cash payment, the client will be required to purchase full insurance coverage with a deductible. The renter authorizes the rental company to charge their credit or debit card for any amounts due under this contract, including but not limited to the security deposit, rental fees, damage caused, and total or partial theft.

19. APPLICABLE LAW AND JURISDICTION

The renter agrees to rent the selected vehicle and declares, regardless of their nationality or language, that they have read and understood this contract. To resolve any doubts or disagreements that may arise from the interpretation or fulfillment of this agreement, both parties expressly waive their own jurisdictions and submit to the courts of Málaga. This contract may be delivered to the renter in a translated version. In the event of any legal dispute, the original version in Spanish shall prevail.
